Social media can adversely affect your child custody case

Child custody in New York is like most states. You can have legal custody, physical custody or a combination of the two. If there are disputes regarding who spends more time with the child or who has control over which areas of the child's life, the court may have to intervene.

The court will base its decision on several factors. You can expect the process to take time. It might be helpful to your case if you avoid sharing things online. But if you must share content or information on social media, here are things that might negatively impact your child custody battle:

Posting negative comments or opinions about your ex

Before awarding child custody to a parent, the court must ensure that the parent is mentally and physically stable. The court also investigates each parent's ability to cooperate with the other parent. Posting disparaging comments and snide remarks about your child's other parent can make you look disturbed or unstable. The court may consider you unfit to parent or even co-parent. It can also exacerbate an already conflicting situation.

Posting stories or photos with alcohol or controlled substances

You would not want to incriminate yourself by posting suggestive videos and photos online. If these contain alcohol or drugs, the court may have reason to believe you have a substance abuse problem.

Sharing photos of luxury items and expensive trips

While boasting affluence is prevalent in social media, it may indicate that you do not know how to manage your finances. Furthermore, posting about costly affairs may affect child support and alimony matters.

It would help if you always assumed that your ex has access to any information you have on social media. Change all your passwords regularly. You share a child with this person; you might have shared your password too.
